Throughout these terms, "we", "us" and "our" refer to GymCoquette. "You" refers to the user or customer.
2. Acceptance
By visiting our site or placing an order, you agree to these terms. If you do not agree, please do not use the site. We may update these terms at any time; the version published at the time of your order applies to that order.
3. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.
4. Products
We make every effort to display colours and details accurately, but we cannot guarantee that your screen shows colours exactly as they appear in person. Product measurements are approximate. All products are subject to availability; we may withdraw or change a product at any time.
5. Orders and contract formation
Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation email. We may refuse or cancel an order if:
- The product is out of stock
- There was an error in the price or product description
- We suspect fraud or an unauthorised payment
- We cannot ship to your address
If we cancel an order you have paid for, we refund you in full.
6. Prices and payment
Prices are shown in the currency selected at checkout and include VAT where applicable. Shipping is added at checkout. We reserve the right to change prices at any time, but changes do not affect orders already confirmed.
Payment is taken at the time of ordering. We accept the payment methods displayed at checkout. We do not store your full card details.
7. Delivery and returns
Delivery times, costs and your return rights are set out in our Shipping & Returns policy, which forms part of these terms.
8. Intellectual property
All content on this site — text, images, logos, designs and the GymCoquette name — is our property or used under licence and may not be copied, reproduced or used commercially without our written permission.
9. Acceptable use
You agree not to use the site for any unlawful purpose, to transmit malicious code, to scrape or harvest data, or to interfere with the site's operation.
10. Reviews and submitted content
If you submit a review, photo or comment, you grant us a non-exclusive, royalty-free licence to use it in connection with our business. You confirm the content is your own and is not unlawful or offensive. We may remove any submission at our discretion.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses, loss of profit, or loss of opportunity. Our total liability for any order is limited to the amount you paid for that order.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable consumer law. Your statutory rights as a consumer are not affected.
12. Health and safety
Our products are clothing, not medical or protective equipment. Consult a doctor before beginning any exercise programme. We are not responsible for injuries sustained during exercise.
13. Third-party links
Our site may link to third-party websites. We are not responsible for their content, products or privacy practices.
14. Force majeure
We are not liable for delay or failure to perform caused by events outside our reasonable control, including carrier disruption, customs delays, natural events, strikes or government action.
15. Governing law and disputes
These terms are governed by Czech law. If you are a consumer, you also benefit from the mandatory consumer protection rules of the country in which you live, and you may bring proceedings in your local courts.
Consumers in the Czech Republic may use the out-of-court dispute resolution service of the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz).
16. Severability
If any provision of these terms is found invalid, the remaining provisions continue in full effect.
